LetEmily Terms of Service

1. Accounts

• You must be at least 18 years old to use LetEmily.
• You are responsible for keeping your login secure.
• You are responsible for all activity under your account.

2. Subscriptions & Payments

• LetEmily's core features are free forever on the Free plan.
• LetEmily Pro subscriptions are billed monthly or annually through Stripe.
• No refunds are provided.
• Pricing may change in the future; we will provide advance notice before any changes take effect.

3. AI-Assisted Insights & Ask Emily

General features

• LetEmily provides intelligent summaries and insights, including those generated from uploaded images or documents.
• You are solely responsible for reviewing, approving, and acting on insights before sharing them with your team.
• By uploading content, you grant LetEmily permission to process that content for insights within the service.
• Uploaded content must follow policy: no illegal, abusive, or infringing material.

Ask Emily: AI-powered leadership support

• User Responsibility: Ask Emily provides insights meant to support reflection and growth. It does not issue commands, make decisions, or replace human judgment. All final decisions remain your responsibility.
• Data Handling: What you send to Ask Emily is processed solely to generate your response. It is not used to train any model, is not retained by our AI provider for training (a Data Processing Addendum is in place), is never shared outside your account, and is never used to evaluate anyone’s performance.
• Confidentiality: Ask Emily works over the team context you have already stored in LetEmily and is designed to hold it. Conversation history is retained so answers stay useful across sessions, and it is encrypted at rest and private to your account. You remain responsible for what you record about the people you lead and for meeting any obligation your employer, regulator or profession places on that information. Do not enter categories of data your organisation prohibits from third-party processing.
• Limitations: Ask Emily is not designed to address crises, grievances, or regulated HR/legal matters. For these, escalate to appropriate human channels.
• Voluntary Use: Use of Ask Emily is entirely voluntary. Bright Root Labs LLC disclaims all liability for decisions, actions, or outcomes resulting from AI-generated suggestions.

4. Communications

• To you, the manager: account email (verification, password reset, billing), and, according to your notification preferences, reminders and summaries such as meeting reminders, follow-up reminders, the weekly reflection and the Morning Report. The optional ones can be turned off in settings.
• To a member of your team: email is sent only as the direct result of an action you take, and is limited to an introduction form you send them, an invitation to a meeting you schedule, and a meeting recap you choose to send. Emily does not decide to contact anyone. She never messages, emails or schedules on your behalf, and she sends nothing to your team on her own initiative.
• You are responsible for ensuring that any communications sent through LetEmily comply with applicable laws and with any policies set by your employer or organization.
• Bright Root Labs LLC is not responsible for violations of corporate or contractual policies that may apply to you.

5. Acceptable Use

You agree not to misuse LetEmily. Prohibited actions include:

• Illegal activity.
• Abusive behavior toward staff, systems, or other users.
• Attempting to hack, reverse engineer, or disrupt the service.
• Attempting to jailbreak AI integrations or use LetEmily beyond its intended purpose without express written consent.

Violations may result in immediate suspension or termination of your account.

6. Termination

• If you cancel your LetEmily Pro subscription, your account reverts to the Free plan at the end of the period you have paid for and you keep access to core features. Your data: your people, notes, meetings and commitments: is retained, and you can return to Pro at any time.
• Cancelling a subscription does not delete your account. Deleting your account is a separate, deliberate action in Settings, and it is immediate and permanent: your data is destroyed at that point and cannot be recovered. Export anything you want to keep first.
• We retain an anonymised audit record of the deletion for 30 days for accountability, as described in our Privacy Policy. It contains no personal data.
• Bright Root Labs LLC reserves the right to suspend or terminate accounts at its sole discretion for violations of these terms.

7. Disclaimers & Limitation of Liability

• LetEmily is provided "as is" and "as available", without warranties of any kind.
• Bright Root Labs LLC does not guarantee uninterrupted or error-free service.
• To the maximum extent allowed by law, Bright Root Labs LLC is not liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill.

8. Governing Law

These Terms are governed by the laws of the State of New Jersey, USA. Any disputes must be resolved in the courts located in New Jersey.

9. Changes to These Terms

We may update these Terms of Service from time to time. If changes are material, we will provide notice before they take effect.

10. User Responsibility

• You are responsible for obtaining all necessary permissions and consents before uploading content or entering personal information about others into LetEmily.
• You are responsible for ensuring that your use of LetEmily complies with your own employment agreements, confidentiality obligations, and workplace policies.
• Bright Root Labs LLC is not liable for any consequences resulting from your failure to comply with such obligations.
